JUH Passed Four Point Resolution on Tripple Talaq Bill

New Delhi : With the Central Government showing defiance about triple Talaq Bill, The National Working Committee Meeting of Jamiat Ulama-i-Hind rejected the ‘Triple Talaq bill terming it unacceptable to the Muslim community. The meeting under the presidentship of Maulana Qari Mohammd Usman Mansoorpuri, JUH national president concluded here at JUH central ITO office New Delhi passed a four points resolution in this regard.

JUH national WC unequivocally called this  an interfere in the religious affairs of the Muslim Community and said that based on the provisions in the Constitution of India, the judiciary and the Parliament do not have any right to interfere in the religious affairs of the Muslim Community. Therefore, any such law interfering in the Shari’ah, if passed by the Parliament or enforced through an ordinance, will not be acceptable to the Muslims anyway. The Muslims are religiously duty bound to adhere to Shriah at all and will keep doing so.

The other points of the resolution reads, “(1) The proposed ‘Triple Talaq Bill’ introduced in the Parliament is not going to favour the Muslim divorced women any way. It will instead cause sheer injustice to them. Therefore, this law is not acceptable. Under this law, it is most likely that the divorced woman will remain hanged up for long time causing roadblock for her to re-marry and begin her marital life afresh. This way, the sole purpose of the institution of Talaq itself will get undermined.”

“Apart from that, it is the woman and her siblings who will actually suffer the outcome of man’s imprisonment. Other numerous defects of this proposed bill have been communicated to the government through different channels.”

“In addition to that, the Government did not need to consult the community which is directly concerned in this bill. The pieces of recommendations given by the religious fraternity, Shariah expert organizations have also been completely brushed aside. The government seems to adopt a hostile attitude and to forcefully suppress the public opinion and principles of justice which is shameful for a democratic nation. We consider that this Government is trying to impose Common Civil Code under this guise depriving religious rights of the Muslim Community.”

“All the Muslims are strongly appealed to completely avoid the form of Talaq Bid’at and perform the rituals of Nikah, Talaq and other family affairs in accordance with the ruling of Shari’ah, so that the Governments may not chance upon to interfere in our religious matters.”

“In case of domestic disputes, they should resort to the Darul Qada and avoid involving in judicial tangle in the mainstream court.”

While releasing this resolution to media, JUH National General Secretary, Maulana Mahmood Madani said that the Government should impose law upon us. “The way the government is responding is tantamount to trampling upon democratic values of the country” added Maulana Madani.

Maulana Madani said that we also passed resolution with regards to recent orders of the Honorable High Court of Allahabad on use of the loudspeakers. The resolution in this regard says, “This WC of Jamiat Ulama-i-Hind appeals to all the Muslims to seek permission from the concerning authorities and fulfil the legal procedure for the use of loudspeakers in the mosques. If they find any difficulty in this regard, they may contact offices of the centre or state Jamiat Ulama-i-Hind.
