NCHRO wrote a letter to the CJI regarding rampant misuse of UAPA and PSA in Jammu and Kashmir

Recently, the data regarding the detentions in Jammu and Kashmir since the last 2 years came out in public.

It was revealed that since 2019, the Jammu and Kashmir (J&K) administration has booked over 2,300 people in more than 1,200 cases under the Unlawful Activities (Prevention) Act, and 954 people under the Public Safety Act (PSA).  46 per cent of those booked under UAPA and about 30 per cent of those detained under PSA are still in jail, both inside and outside J&K. According to official police data, 699 people were detained under PSA in 2019, and 160 in 2020. Those booked under PSA, include former chief ministers Omar Abdullah, Farooq Abdullah and Mehbooba Mufti.

In 2021, 95 people were detained under PSA till July-end. Of these, many continue to remain under detention. Over 5,500 people were taken into preventive custody under Section 107 of the CrPC in 2019. Home department sources claim that all of them have since been released.

These are all official data of the J&K Police, reviewed and published by the newspaper The Indian Express.

Many of the people detained without any reason. After the revocation of the special status of the state, even many former office bearers of political parties were arrested without assigning the reason. The laws are used for political reasons and not to fight insurgency or terrorism. This was not only unjust but also patently illegal.

Against this rampant misuse of stringent laws, human rights organisation the National Confederation of Human Rights Organisation (NCHRO) wrote a letter to the Chief Justice of India. We see this kind of usage of the law to silence dissenters a threat to democracy and human rights.

NCHRO ने जम्मू-कश्मीर में यूएपीए और पीएसए के बड़े पैमाने पर दुरुपयोग के संबंध में सीजेआई को पत्र लिखा

हाल ही में जम्मू-कश्मीर में पिछले 2 साल से बंदियों को लेकर आंकड़े सार्वजनिक हुए थे।

यह पता चला कि 2019 के बाद से, जम्मू और कश्मीर (J & K) प्रशासन ने अनलॉफुल एक्टिविटीज (प्रिवेंशन) अधिनियम (UAPA) के तहत 1,200 से अधिक मामलों में 2,300 से अधिक लोगों और पब्लिक सेफ्टी एक्ट (PSA) के तहत 954 लोगों पर मामला दर्ज किया ।

UPA के तहत बुक किए गए 46 फीसदी और PSA के तहत हिरासत में लिए गए लोगों में से लगभग 30 फीसदी अभी भी जम्मू-कश्मीर में और उसके अलावा जेल में हैं। आधिकारिक पुलिस आंकड़ों के अनुसार, 2019 में पीएसए के तहत 699 और 2020 में 160 लोगों को हिरासत में लिया गया था। पीएसए के तहत जिन लोगों पर मामला दर्ज किया गया है, उनमें पूर्व मुख्यमंत्री उमर अब्दुल्ला, फारूक अब्दुल्ला और महबूबा मुफ्ती शामिल हैं।

2021 में जुलाई के अंत तक 95 लोगों को पीएसए के तहत हिरासत में लिया गया था। इनमें से कई अभी भी हिरासत में हैं। 2019 में सीआरपीसी की धारा 107 के तहत 5,500 से अधिक लोगों को निवारक हिरासत में लिया गया था। गृह विभाग के सूत्रों का दावा है कि उन सभी को रिहा कर दिया गया है।

ये सभी जम्मू-कश्मीर पुलिस के आधिकारिक आंकड़े हैं, जिनकी समीक्षा और पब्लिकेशन अखबार द इंडियन एक्सप्रेस अखबार ने किया है।

हिरासत में लिए गए कई लोगों को बिना किसी कारण के ऐसा किया गया। राज्य का विशेष दर्जा समाप्त किए जाने के बाद राजनीतिक दलों के कई पूर्व पदाधिकारियों को भी बिना कारण बताए गिरफ्तार कर लिया गया। कानूनों का उपयोग राजनीतिक कारणों से किया जाता है न कि उग्रवाद या आतंकवाद से लड़ने के लिए। यह न केवल अन्यायपूर्ण था बल्कि पूरी तरह से अवैध भी था।

इन कानूनों के इस तरह के दुरुपयोग के खिलाफ मानवाधिकार संगठन नेशनल कॉन्फेडरेशन ऑफ ह्यूमन राइट्स ऑर्गनाइजेशन (NCHRO) ने भारत के मुख्य न्यायाधीश को एक पत्र लिखा। कानून के इस तरह के अलोकतांत्रिक उपयोग को हम लोकतंत्र और मानवाधिकारों के लिए एक खतरे की तरह देखते हैं।
